If you own a trademark, you are already protecting your brand and building a unique identity for your business in market. But did you know how long a trademark registration is valid? Trademark registration is not for forever. Just like your passport and other licences, it expires and needs to be renewed in every 10 years.

What is a Trademark?

A trademark is a unique sign, logo, word or symbol which is used to identify your brand, product or services. It helps your customer to distinguish your productsor services from others. It also provides legal protection. Registering a trademark ensures nobody else can use your brand identity.

TM vs R: When to Use Which Symbol in Trademark?

Confused whether to use ™ or ® with your brand name or logo? Here’s a simple table to clear the confusion:

Trademark Validity || For How Long Is It Active?

A registered trademark is valid for 10 years from the date of registration. After 10 years, you must renew the same if you want to continue enjoying your trademark protection. Non-renewal may lead to removal of your trademark from the register and it will be available to others.

When Should You Renew Your Trademark?

  • You can apply for renewal anytime within 6 months before the expiry date as per rules 63 and 64 in Trade Mark rules 2002.
  • A grace period of 6 months after expiry is also allowed but with additional late fees.
  • If you don’t renew even within the grace period, your trademark becomes liable for removal.

Documents required for trademark renewal

  • A copy of registration certificate
  • Trademark Registration Number
  • Power of Attorney (if we’re filing on your behalf)
  • Digital Signature Certificate (DSC)
  • ID proof of applicant (if required)

Trademark renewal fees depend upon the mode of renewal, whether it is in physical mode or online mode

Trademark Renewal Process

Follow below steps to file renewal application of your trademark online:

Step 1: Visit the IP India Website

visit the official IP India portal (here is the link: https://ipindiaonline.gov.in).

Step 2: Login with Credentials

Use your registered username and password to log in.

Step 3: Select Form TM-R

Choose Form TM – R. This form is used specifically for trademark renewal.

Step 4: Enter Trademark Number

You need to enter your Trademark Registration Number. The system will auto-fill the basic trademark details.

Step 5: Fill in Missing Details

If any information is missing, you can manually fill it in at this stage.

Step 6: Upload Documents

Upload supporting documents, if required (like Power of Attorney, ID proof, etc.).

Step 7: Preview & Sign the Application

Check the preview of your form. If everything looks good, digitally sign the form using your DSC (Digital Signature Certificate).

Step 8: Make Payment

After signing proceed to make payment. Avoid making payment using Internet Explorer as it often leads to payment issues. Use Chrome browser for smoother transactions.

Step 9: Download Receipt & Acknowledgment

After successful payment, always download your Payment Receipt and Acknowledgement Form as these documents serve as proof of your trademark renewal.

What to do in case of an Objection?

Sometimes, the Trademark Officer may raise a query or objection if:

  • Some documents are missing
  • There is a discrepancy in the application

In such cases, you will receive a notification on your registered email or portal. Simply respond within the time limit and submit your response with required documents.

Don’t wait till last minute for your renewal. You should proceed to renew your trademark atleast 2-3 months before the expiry date to avoid late fees, delay and other complications
